Instagram Photo Competition

Vacations & Travel and ASEAN have teamed up to give you the chance to win a $100 Coles voucher – we have 100 to give away in total! There are 10 vouchers up for grabs each fortnight from February through to July 2022. 

The Association of Southeast Asian Nations (ASEAN) includes Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, The Philippines, Singapore, Thailand and Viet Nam. Each fortnight we’ll be inspiring you to travel (or return) to these charming countries.

Plus, if you’ve visited one of the featured countries, you could win a $100 Coles voucher by sharing your travel photo to Instagram. All you need to do is share a post of the fortnightly featured destination and use the competition tags and hashtags below to be in the running to win.

Destination of the Fortnight: The Philippines

TERMS AND CONDITIONS

AUSTRALIAN TRAVEL AGENTS TUESDAY GIVE-AWAY (COMPETITION).

Below are the terms and conditions for the Competition. By submitting an entry for the Competition, you agree to be bound to these terms and conditions.

 

  1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
  2. The Organiser is the Philippine Department of Tourism ABN 68 017 144 671 

 

COMPETITION PERIOD

  1. The Competition will commence on 30 November 2021 at 9:00AM AEST and end on 21 December 2021 at 5:00PM AEST (Competition Period).
  2. Entries open on the Tuesday of each week of  the Competition Period
  3. Entries close on midnight of the same day.
  4. The competition winner will be announced at 3pm every Friday of the competition week. 

 

ELIGIBLE ENTRANTS

  1. Entry is open to Australia-based Travel Agents (Eligible Entrants). 
  2. Directors, management and employees of the Organiser and their immediate family are not eligible to enter the Competition. In addition, retailers, suppliers, associated entities and agencies engaged by or related to the Competition are ineligible to enter.
  3. For the purposes of clause 8, “immediate family” includes a person’s spouse, ex-spouse, de-facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, step-siblings, or first cousin, whether or not they live in the same household.
  4. The Competition requires no purchase or payment to enter. However, Eligible Entrants are responsible for all reasonable expenses to submit an entry.

 

SUBMITTING AN ENTRY

  1. Eligible Entrants may enter the Competition by posting their entry on their Instagram page. captioning it, and following and tagging DOT ANZ’s Instagram account @tourismphilippines and two other Australia-based travel agents. 
  2. Eligible Entrants must post their original favourite Philippine destination photo, add a caption, tag @tourismphilippines and two other Australia-based travel agents. 
  3. The photo must be original and owned by the entrant and made accessible to the public. Captions must be original.
  4. Once the entry has been posted on the entrant’s Instagram page with the proper captions and tags, the entry will be taken to have been officially submitted as a valid entry. Once an entry has been submitted, no changes to or withdrawal of the entry will be permitted.

 

JUDGING

  1. For the avoidance of doubt, the Competition is a game of skill and chance does not play any part in determining the winners.
  2. The judges will determine the winners based on the following five (5) criteria, each with equal weighting of 20%: adherence to the contest theme, originality and creativity, technical quality, visual and adherence to mechanics. The maximum score will be 100%.
  3. The entry with the score closest to 100% will be deemed the winner. 

 

PRIZE

  1. The prize that will be given to the winner for each  week is a gift voucher with a total value of AUD200 (Prize).
  2. All taxes and local government fees (excluding GST) that may be payable as a consequence of receiving the Grand Prize are the sole responsibility of the winners.
  3. The Organisers are not liable for any loss or damage (even if caused by negligence) as a result of any winner accepting and/or using the Prize, except for any liability which cannot be excluded by law.
  4. Eligible Entrants acknowledge that the Organisers make no promise or guarantee regarding the suitability of the Prize and that any products or services received as a consequence of winning the Prize are not the responsibility of the Organisers

ANNOUNCEMENT OF WINNERS

  1. Each week a winner will be announced from the entries submitted every Tuesday. Winners will be notified on Instagram on the Friday of the contest week. 
  2. The Organisers will send the prize to the winner by mail to their nominated Australian business address. 

 

PRIZE SUBSTITUTION

  1. In the event that any part of the Prize becomes unavailable for reasons beyond the Organisers’ control, the Organisers may, at their absolute discretion, substitute a prize (or the relevant part of a prize) with a prize of equal or greater value.
  2. The Prize is not redeemable for cash or credit under any circumstances.

 

UNCLAIMED PRIZES 

  1. The Organisers will use its best endeavours to contact the winners of a Prize using the contact details provided in their entry. However the Organisers will not be liable for the winners’ failure to receive a notification of winning if they provided incorrect contact details, their email security settings caused the notification to enter the spam or junk folder, or if they have not updated their domain or email subscription to receive the notification.
  2. If a prize is not accepted or claimed within 72 hours from written receipt by the Organisers, the winners will no longer be entitled to the prize. If the winners fail to comply with the instructions in a written notification on claiming the prize, the winners’ entry will be disqualified and they will not be entitled to the applicable prize.
  3. If the winners do not accept or claim a prize in accordance with clause 27, then the prize can no longer be redeemed by the winners. The Organisers reserve the right to appoint new winners by conducting a second judging round of the entries in accordance with clause 16.

 

USE OF ELIGIBLE ENTRANTS’ PERSONAL INFORMATION

  1. Personal information including Eligible Entrants’ names, addresses, telephone numbers, emails, nominated bank account details, wedding details (such as venues, suppliers, images and videos) will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and the Organisers’ agents or third-party service providers, such as hotels, airlines and transfer companies, for the purposes of conducting the Competition or for promotional and marketing purposes, including on social media (Purpose).
  2. By entering this Competition, the Eligible Entrants consent to the use of their personal information for the Purpose, and that the Organisers may contact them for future marketing and material purposes without payment. Eligible Entrants agree that the Organisers may use this information for that purpose and disclose it to other organisations or persons, including overseas service providers that may use it in any media for the Purpose.
  3. The Organisers may contact the Eligible Entrants to participate in publicity, photography and any other promotional activity as the Organisers reasonably require without any compensation. 
  4. When submitting an entry, the Eligible Entrants must ensure that the relevant waivers and photo release forms are signed by anyone who appears in any Videos or images submitted in an entry.

 

ENTRY CONTENT

  1. Entries must be the Eligible Entrants’ original photos and captions.  The Organisers reserve the right to require the Eligible Entrants to verify that the entry is the Eligible Entrants’ original work. If the Organisers are unable to verify that the entry is original work to their satisfaction, the entry will be deemed invalid.
  2. Eligible Entrants warrant that their entry is not in breach of any third-party intellectual property rights. If the Eligible Entrants have engaged third party service providers for any part of the entry’s content (such as videographers and photographers), the Eligible Entrants warrant that they have the necessary licences and rights to include such content in their submission for the Purpose. Entrants agree to indemnify the Organisers and their associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of the warranty set out in this clause.
  3. Eligible Entrants’ entries must not include:
  1. any images, video or voice of any person without that person’s express consent (including by ensuring that person has signed a release form) for such image, video or voice to be used by the Organisers for the Purpose;
  2. any content that contravenes any law; and
  3. any content that is obscene, offensive, potentially defamatory, discriminatory, indecent, prejudicial or inconsistent with prevailing community standards.
  1. By entering this Competition, Eligible Entrants consent to the Organisers dealing with their entry content in any way that may otherwise the Eligible Entrant’s moral rights, and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Organisers or its assignees, licensees or successors. 
  2. Eligible Entrants consent to providing an original copy of the entry content for the Organisers to edit for the purpose of shortening the content for use and publication on various social media to promote the Competition.
  3. Eligible Entrants consent to the Organisers using their name, likeness, image and/or voice in the event that they are shortlisted as a winner, or become a Winner in the Competition, in any media for an unlimited period of time without remuneration or compensation for the Purpose and/or promoting any services supplied by the Organisers.

GENERAL CONDITIONS

  1. The Organisers’ judging criteria and decision to award any prize to a particular entry is final and binding and no correspondence will be entered into in relation to any disputes associated with the Organisers’ decisions. 
  2. The Organisers accept no responsibility for late, lost or misdirected entries or other communications.
  3. Should an Eligible Entrant’s contact details change during the Competition Period, or any given Month during which an Eligible Entrant has submitted an entry during the Competition Period, it is the Eligible Entrant’s responsibility to notify the Organisers. A request to access or modify any information provided as part of the redemption of a prize should be directed to the Organisers.
  4. The Organisers may at their absolute discretion request verification of any personal information of Eligible Entrants provided for the purposes of the Competition and arranging a prize, including but not limited to bank account details and passport information. 
  5. The Organisers reserve the right to disqualify any individual who breaches these terms and conditions, submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the fair and proper conduct of this Competition. Failure by the Organiser to enforce any of its rights does not constitute a waiver of those rights.
  6. By entering this Competition, Eligible Entrants acknowledge and agree that these terms and conditions, the Competition and the consequences of receiving a prize may be subject to the terms and conditions of third-party service providers such as social media platforms, video platforms, payment providers, airline companies, hotel accommodation companies and transfer companies (Third Party Terms). The Organisers will not be liable for any damage or loss suffered by the Eligible Entrants in connection with such Third Party Terms.  
  7. Participants in the Competition may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Organisers. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the maximum extent that it is permitted to do so by law, the Organisers (including its officers, employees and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, incidental, special or consequential, arising in any way out of the Competition, including, without limitation:
  1. any technical difficulties or equipment malfunction (whether or not under the Organiser’s control);
  2. any theft, unauthorised access or third party interference;
  3. any entry that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Organiser) due to any reason beyond the reasonable control of the Organiser;
  4. any variation in market value of the Grand Prize to that stated in these terms and conditions;
  5. any tax implications and/or;
  6. the prizes or use of the prizes.
  1. Eligible Entrants and winners of the Competition agree at all times to indemnify and hold harmless the Organisers and its officers, employees and agents (“those indemnified”) from and against any loss (including reasonable legal costs) or liability incurred or suffered by any of those indemnified where such loss or liability was caused by the Eligible Entrants and/or winners or their officers’, employees’ or agents’:
  1. breach of any term of these terms and conditions; or
  2. negligent, fraudulent or criminal act or omission.
  1. The Organiser will not be  liable for performance delays nor for non-performance due to causes beyond their reasonable control, including any decision of a government authority in relation to COVID-19. If the Competition is not capable of running as planned, the Organisers reserve the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify, or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.
  2. These terms and conditions are governed by the laws applying in New South Wales, Australia.
